Study on the relationship between the criminal control of the labor force and the transformation of social law to security in merchandise in the context of neoliberal capitalism

Summary: The objective of this study is to analyze whether the intensification of the criminal control of the labor force in contemporary Brazilian capitalism, besides guaranteeing the conditions of reproduction of structural violence in neoliberal times, favors the commercialization of the social right to security. In order to do so, bibliographical and documentary research was carried out to demonstrate the historical process of insertion of capitalism within criminal control, the obstacle generated by the regulated phase of Keynesian capitalism and the resumption of the economic possibilities of generating money by criminalizing the poor with the posture Of the neoliberal penal state. It can be seen that there is an organic relationship between the types of punishment adopted in the criminal sphere and the productive needs corresponding to the different phases of the capitalist mode of production. However, this relation brings in its wake another possibility, precisely the guiding thread of the research: The potential to generate added value with the criminalization of the workforce. Thus, criminal control, as well as guarantor of structural violence, also functions as an agent of its expansion, since it has become the presupposition of a new consumer market: the violence market. Thus, this research throws its eyes beyond the increasing privatization of prisons and the intense commercialization of private security for other companies, since the sustained hypothesis consists in affirming that the resurgence of the criminal control of the labor force in the Brazilian contemporary capitalism is a presupposition for The transformation of social law to security in merchandise, since it is from the processes of criminalization of a selected target public, with the respective visibility, that it creates for the people in general the need to consume a product or service to protect themselves, That is, the fear of being the victim of a crime, in a true fetish of the commodity.
